Product Trial Agreement

  • This agreement is between the Facility specified below (“Facility”) and The PostureWorks LLC (“The PostureWorks”).
    1. Facility requests a trial of The PostureWorks’ product(s) for a period of one week. The trial period shall commence upon the delivery of the product(s) to the Facility.
    2. Facility will retain original packaging (plastic bag/box) to use in the event the product(s) need to be returned.
    3. Facility may use the product(s) during the trial period with any patients selected by the Facility. Facility will use their professional judgment regarding the clinical appropriateness of The PostureWorks products for each individual patient.
    4. Facility agrees to take care of the product(s) and prevent abuse of the products during the trial period. Care instructions are included with your trial products and are posted at www.thepostureworks.com.
    5. At the expiration of the trial period, Facility agrees to either:
      1. Purchase some or all of the trial product(s) at the prices listed below; applicable taxes and shipping charges will also be applied.
      2. and / or

      3. Return some or all of the trial product(s) to The PostureWorks:
        1. The PostureWorks shall provide Facility with a pre-paid UPS shipping label for the return of any trial product(s).
        2. Facility should use original packaging material (plastic bag/box) to properly package the product(s). If the trial product(s) were dropped off, or the original packaging is unavailable, customer shall obtain appropriate shipping and packing materials. Facility will deliver the product(s) to UPS or an authorized UPS shipping center.
        3. Facility will be responsible for ensuring that the product(s) are cleaned (free of all debris) and disinfected (using standard facility disinfectants) prior to their return to The PostureWorks. Facility will follow cleaning instructions as outlined in “Manufacturer’s Instructions.” Facility agrees to pay a $30 cleaning fee for each cushion returned that has not been cleaned properly.
    6. In the event that the Facility does not purchase the product(s), or if the Facility does not return the product(s) in a reasonable period, The PostureWorks will invoice the Facility for the product(s).
